The Supreme Court of India ruled that parental income alone cannot be the sole criterion for determining OBC creamy layer status. Authorities must also consider parental occupation, social position, and nature of employment.
The judgment addresses disparities in treatment between government employees and PSU/private sector workers. The creamy layer concept — introduced in the 1992 Indra Sawhney judgment — currently excludes individuals earning above ₹8 lakh annually from the 27% OBC reservation. This ruling aims to ensure reservation benefits genuinely reach the most backward sections.
