  • The Karnataka High Court has recognized menstrual leave as a fundamental right under Article 21 of the Indian Constitution, linking it to the right to dignity and humane working conditions.
  • Justice M. Nagaprasanna observed that menstruation is a natural biological process, and supporting women during this period upholds equality and social justice.
  • The court directed the state government to strictly implement the menstrual leave policy across all sectors, including the unorganized workforce, through guidelines and administrative measures.
  • This order will remain in force until the Karnataka Menstrual Leave and Hygiene Bill, 2025 is enacted. The ruling came on a petition filed by a daily wage woman worker from Belagavi.
