The Supreme Court of India has struck down the age limit on maternity leave for adoptive mothers, calling it unconstitutional. In the Hamsaanandini Nanduri case, the court ruled that all adoptive mothers are entitled to 12 weeks of leave regardless of the child’s age.
The earlier restriction under the Social Security Code 2020 violated equality rights. The judgment emphasises caregiving and child welfare, and also urges the government to consider paternity leave reforms.
